Heralds of the Gospel Foundation, Inc., et al. v. Varela, Case No. 1:17-cv-22281 (S.D. Fla. 2017): Represented plaintiffs in trade secret misappropriation and copyright infringement action. Obtained ex parte temporary injunctive relief and first chaired evidentiary hearing on motion for preliminary injunctive relief.
Mirabel Technologies, Inc. v. Caputo, et al., Case No. CACE08023228 (Fla. 17th Cir. Court, 2008): Represented plaintiff in trade secret misappropriation and breach of non-competition agreement case. Obtained temporary injunction that resulted in favorable settlement for the client.
Siemens Medical Center Solutions USA, Inc., et al. v. Saint-Gobain Ceramics & Plastics, Inc., Case No. 6:08-MC-00024 (M.D. Fla. 2008): Defended third party whose patented crystal scintillation technology for PET scanning devices was the center of a co-pending $50 million dispute.
Delaware Valley Floral Group, Inc. v. Shaw Rose Nets, LLC, Case No. 1:07-cv-20199 (S.D. Fla. 2010): Represented plaintiff in a patent infringement lawsuit seeking declaratory relief. Case was dismissed in client’s favor on summary judgment and affirmed by the Federal Circuit Court of Appeals.
Grupo Anderson’s S.A. de C.V. v. Operadora Anderson’s, S.A. de C.V., Case No. 12-cv-01821 (D. Nev. 2012): Represented defendant in dispute involving alleged breach of worldwide license agreement for the client’s trademark portfolio. Case was voluntarily dismissed by plaintiff following a favorable hearing on motion to dismiss defendant’s application for enforcement of a foreign arbitration award.
Woods v. DeAngelo Marine Exhaust, Inc., Case No. 9:08-cv-81579 (S.D. Fla. 2012): Represented defendant in a patent infringement lawsuit against direct competitor. Case proceeded to jury trial where plaintiff’s damages were reduced from $1.2 million to $90,000.
Star EnviroTech, Inc. v. Redline Detection, LLC, Case No. SAC12 1861 DOC (C.D. Cal. 2012): Represented plaintiff in patent infringement action against direct competitor. Obtained favorable claim construction ruling and obtained sanctions, including an adverse inference instruction, against defendant for discovery violations.
Atlas IP, LLC v. St. Jude Medical, Inc., Case No. 14-cv-21006 (S.D. Fla. 2014): Represented interests of defendants in patent infringement action with approximately $850 million in exposure.
