A. Rob Weaver

Rob is a registered patent attorney and Florida Bar Board Certified Specialist in Intellectual Property Law. He has dedicated the entirety of his career to the practice of intellectual property law.

An accomplished litigator, Rob has represented clients in federal and state courts throughout the country. Rob has led litigation matters covering the entire spectrum of intellectual property issues including patent, trademark, and copyright infringement as well as trade secret misappropriation and related business disputes such as breach of license agreements, breach of restrictive covenants, unfair competition and false advertising claims. In many instances, Rob has worked with insurance companies to resolve advertising injury and media liability claims brought against their insured. Rob has also represented clients in administrative proceedings before the U.S. Patent and Trademark Office including the Trademark Trial and Appeal Board and the Patent Trial and Appeal Board. 

Rob is also a trusted adviser in building international intellectual property protection for his clients. Rob utilizes his degree in mechanical engineering to prepare, prosecute, and manage patent portfolios covering a range of technologies. Rob has also managed international trademark portfolios for clients in a variety of industries including medical devices, cryptocurrency, cosmetics, fashion and design, power utilities, insurance, and automotive accessories to name a few. Rob also works through licensing issues as well as providing opinions of counsel and due diligence portfolio reviews as part of examining and leveraging the client's intellectual property rights.

Prior to becoming a member of The Brickell IP Group, Rob practiced over 3 years in the intellectual property department of an AM Law 100 firm. While practicing in "big law," Rob sharpened his trial skills through that firm's trial academy, a rigorous internal training program, and undertook high profile litigation matters that included high stakes patent litigation between multinational companies as well as several matters which culminated in precedential decisions from the U.S. Court of Appeals for the Federal Circuit. Prior to that, Rob practiced with a nationwide boutique intellectual property law firm. Rob began his career as an intern with the University of Miami Technology Transfer Office.

Rob graduated cum laude from the University of Miami School of Law. As a law student, Rob served as President of the Intellectual Property Law Society, Vice-President of the honorary Society of Bar & Gavel, and a Fellow in the STREET Law Program. Rob also received Dean's List recognition, earned Honors in the Litigation Skills Program, and was a finalist in the School's Negotiation Competition. Rob’s bachelor’s degree in mechanical engineering is also from the University of Miami. As an undergraduate student, Rob was awarded the Blake King Award for Best Senior Design Project for improving a bullet proof vest. He also traveled the country as a varsity policy debater for the University's debate program.

Representative Cases/Matters

Becon Medical, LTD v. TalexMedical LLC, Case Nos. 2021-2069 (Fed. Cir.), IPR2020-0028, 30 (PTAB), and 18-cv-04169 (E.D. Penn.) – Represented defendant/petitioner/appellant in patent infringement lawsuit concerning medical devices for infant ear molding. Assumed representation on appeal from the PTAB. Obtained partial reversal leading to additional claims being found invalid on remand to the PTAB, eventually resulting in a favorable settlement.

CreeLED, Inc. v. The Individuals, Partnerships and Unincorporated Associations Identified on Schedule “A”, Case No. 22-cv-02456 (M.D. Fla.) – Represented brand owner in anti-counterfeit enforcement action against defendant sellers operating in an online marketplace.

Verbena Products LLC d/b/a Beauty Vice v. BeSweet Creations, Inc. d/b/a SugarBearHair, Case No. 21-cv-23797 (S.D. Fla.) – Represented plaintiff falsely accused of selling inauthentic vitamins on online marketplace. Matter settled favorably shortly into discovery.

Caribbean Energy Solutions, LLC v. Infiniti Coatings LLC et al., Case No. 1:18-cv-24651 (S.D. Fla.) - Represented defendants in trade secret misappropriation and trademark infringement action concerning anti-corrosive coatings used in HVAC equipment. Successfully obtained a denial of plaintiff's preliminary injunction motion, and the case settled shortly thereafter.

Flickable LLC v. Factum Partners Inc., et al., Case No. 1:17-cv-05273 (S.D.N.Y.) - Represented plaintiffs in intellectual property enforcement action on behalf of cosmetics company selling lip gloss. Matter settled favorably prior to discovery opening.

EHS Lens Phillippines, Inc. v. Essilor International et al., Case No. 3:16-cv-563 (E.D. Va.) - Represented defendants in patent infringement action regarding manufacturing of back-side progressive lens facing potential 9 figures in liability. Matter settled favorably near the close of discovery after receiving the Markman order.

Gamon Plus, Inc. v. Campbell Soup Co., Case No. 15-cv-8940 (N.D. Ill.) - Represented defendants/petitioners in preparing Inter Partes Review petitions for four (4) design patents (IPR2017-0091, 94, 95, and 96]. All four petitions were instituted. The patent owner allowed two (2) of the patents to be invalidated. The Federal Circuit would ultimately reverse a finding of validity for the other two patents in a rare review of a design patent IPR proceeding.

LD Technology, LLC v. Impeto Medical SaS, et al., Case No. 1:15-cv-20109 (S.D. Fla.) - Represented defendant in multi-faceted patent infringement, trademark infringement, and unfair competition regarding sudomotor function measurement medical device technology. Matter settled favorably near the close of discovery after receiving the Markman order. 

Hand and Nail Harmony, Inc. et al. v. GNC Nail Supply et al., Case No. 1:15-cv-467 (W.D. Okla.) - Successfully obtained temporary restraining order in counterfeit enforcement action, resulting in the seizure of counterfeit nail gel polish product and a permanent injunction.  

Fontem Ventures B.V. v. VMR Products, LLC, Case Nos. 14-1655, CV 14-8161, CV 14-9273 (C.D. Cal.) - Represented one (1) of nine (9) defendants in a consolidated patent infringement action concerning early patents on electronic cigarettes. Matter settled favorably after several IPRs were instituted.
